Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services, website, and applications provided by Forged Wellness & Co. PLLC ("Forged Wellness & Co.," "we," "us," or "our"), located in Missoula, Montana. Clinical services are delivered directly by Forged Wellness & Co. PLLC through its licensed Physician Assistant-Certified (PA-C) clinicians operating under Montana's full practice authority. By accessing our website at forgedwellnessco.com, enrolling in a membership, or using any Forged services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

Acceptance of Terms

By accessing or using Forged Wellness & Co.'s website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

We reserve the right to modify these Terms at any time. Material changes will be communicated to members via email and posted on our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

You must be at least 18 years of age to use Forged Wellness & Co.'s services or enter into a membership agreement.

Definitions

The following defined terms are used throughout these Terms, your Membership Agreement, and the treatment-specific informed consent forms you will sign at the time of service.

  • Member: An individual enrolled in a Forged Wellness & Co. membership and bound by these Terms and an executed Membership Agreement. Used interchangeably in clinical records with "Patient" where medical services are involved.
  • Clinician / Provider: A licensed Physician Assistant-Certified (PA-C) or other licensed healthcare practitioner credentialed to practice in the State of Montana who performs Good Faith Exams, orders laboratory testing, prescribes Protocols, and documents clinical care under Forged Wellness & Co.
  • Good Faith Exam (GFE): The in-person or synchronous telehealth encounter, documented by a Clinician, that establishes a chief complaint, history of present illness, review of systems, assessment, and treatment plan prior to any pharmacologic or medical intervention. A current GFE is a prerequisite to receiving any medical service through Forged Wellness & Co.
  • Forged Assessment: The comprehensive baseline evaluation completed at enrollment and repeated as clinically indicated, including bloodwork, body composition analysis, and clinical intake. All Protocols are derived from and periodically re-anchored to this Assessment.
  • Protocol: The personalized treatment plan (including dosing, cycling, monitoring, and follow-up) developed by your Clinician and documented in your medical record.
  • Compounded Product: A medication prepared by a licensed 503A or 503B compounding pharmacy to meet an individualized clinical need. Compounded Products are not FDA-approved as finished drugs.
  • Off-Label Use: Use of an FDA-approved medication in a manner, dose, population, or indication not specifically approved by the FDA but supported by clinical evidence and the professional judgment of your treating Clinician.
  • Category 2 Substance: A bulk drug substance listed under federal compounding regulations for which the FDA has not made a final determination regarding safety or efficacy.
  • Adverse Event: Any allergic reaction, injection-site reaction beyond expected, IV complication, medication error, or near-miss related to services received through Forged Wellness & Co.
  • Treatment-Specific Consent: A separate informed consent document, signed by you before a specific medical or wellness service is rendered. Treatment-Specific Consents supplement these Terms and are maintained as part of your permanent medical record.

Membership Terms & Conditions

Membership Structure

Forged Wellness & Co. offers individual membership tiers — Foundation, Performance, and Executive — providing access to functional longevity medicine, hormone health, weight health, and lifestyle optimization services. Specific inclusions, pricing, and terms are detailed in your individual Membership Agreement signed at enrollment.

Enrollment & Billing

  • Memberships are billed on a recurring monthly basis unless otherwise specified in your Membership Agreement
  • Payment is due on the date specified in your Membership Agreement
  • You are responsible for maintaining accurate, current payment information
  • Failed payments may result in suspension of services until the account is brought current

The Forged Assessment

Every membership begins with a Forged Assessment — a comprehensive evaluation including medical exam, intake history, and baseline laboratory work. Tier-appropriate lab panels are completed at enrollment and repeated as clinically indicated to track progress and adjust your personalized plan. Participation in the initial assessment is a condition of membership.

Cancellation & Refunds

  • Cancellation terms, including any notice periods and early termination fees, are specified in your individual Membership Agreement
  • Cancellation requests must be submitted in writing to hello@forgedwellnessco.com or in person at our Missoula location
  • Refunds are handled in accordance with your Membership Agreement and applicable Montana law
  • Access to services continues through the end of your paid billing period following cancellation

Membership Pauses

Membership pauses may be available under certain circumstances, such as medical necessity or extended travel. Pause terms and any associated fees are outlined in your Membership Agreement.

Billing Model & Insurance

Forged Wellness & Co. is primarily a direct-pay practice. Memberships, compounded medications, labs, and ancillary wellness services are not billed to insurance and are the member's financial responsibility at the time of service.

Insurance — Visit Billing Only: For members who are not fully covered under an employer workplace wellness program, Forged Wellness & Co. accepts a limited number of insurance plans for clinical visit billing only. Insurance coverage does not extend to compounded medications, lab panels, peptide or hormone protocols, lifestyle add-ons, or other ancillary services — these remain direct-pay regardless of insurance status.

Member Responsibility: It is the member's sole responsibility to verify their insurance benefits, coverage limitations, and any applicable deductibles, copays, or prior authorization requirements before receiving services. Forged Wellness & Co. makes no guarantee that any specific visit or service will be covered by your plan. We recommend contacting your insurance carrier directly prior to your first appointment.

Employer Wellness Programs: Members enrolled through an employer workplace wellness partnership should reference their employer program agreement for covered services. Any services received outside the scope of that agreement are billed directly to the member.

HSA / FSA / LSA / HRA: Eligible clinical services may be paid using Health Savings Account (HSA) or Flexible Spending Account (FSA) funds; eligibility is determined by your plan administrator. Certain wellness and lifestyle components may qualify for reimbursement through Lifestyle Spending Accounts (LSA) or Health Reimbursement Arrangements (HRA) offered by your employer. Superbills for qualifying clinical services can be provided on request.

Pricing for services not included in your base membership or employer program will be disclosed to you in advance of service delivery.

Withdrawal of Consent & Treatment Cancellation

You may withdraw consent for any specific treatment or Protocol at any time prior to or during service delivery. Once a medication has been administered, it cannot be reversed; however, you may decline further doses and request an alternative plan from your Clinician. Refund eligibility for undelivered treatments is described in your Membership Agreement and the applicable Treatment-Specific Consent.

Medical Disclaimer & Good Faith Exam

Forged Wellness & Co. provides functional longevity medicine, hormone health, and weight health services directly through its licensed clinicians. Please understand the following:

  • Not emergency care: Forged Wellness & Co. is not an emergency medical facility. In the event of a medical emergency, call 911 or go to your nearest emergency room immediately.
  • Not a replacement for primary care: Forged's precision medicine services are designed to complement, not replace, your relationship with your primary care physician. We encourage all Members to maintain an active relationship with their primary healthcare provider.
  • Good Faith Exam required: No pharmacologic Protocol, injection, infusion, or prescription service will be initiated without a current, documented Good Faith Exam performed by a licensed Clinician. The GFE establishes medical necessity, rules out contraindications, and forms the basis for any Protocol you receive.
  • Treatment-Specific Consent: Each medical or wellness intervention — including but not limited to peptide therapy, GLP-1 therapy, growth-hormone secretagogues, hormone replacement therapy, IV therapy, and laboratory services — requires a separate Treatment-Specific Consent signed before the service is rendered.
  • Jurisdiction & licensure: Clinical services requiring a licensed prescriber (including telehealth follow-ups) are provided only in states where the treating Clinician holds an active, unrestricted license. Forged Wellness & Co. does not provide medical services to individuals residing or physically present in a state where the Clinician is not licensed.
  • Individual results: Health outcomes vary by individual. Forged Wellness & Co. does not guarantee specific medical results from any service, treatment, or Protocol.
  • Informational content: Information provided on our website or in educational materials is for informational and educational purposes only. It does not constitute medical advice until delivered in the context of a practitioner-patient relationship established through a Good Faith Exam.

Regulatory Status of Compounded & Off-Label Therapies

Some Forged Protocols involve Compounded Products, Off-Label Use of FDA-approved medications, and/or bulk substances classified as Category 2 under federal compounding regulations. By enrolling in such a Protocol, you acknowledge and accept the following:

  • Compounded Products are not FDA-approved as finished drug products. They are prepared by licensed 503A or 503B compounding pharmacies to meet your individualized clinical needs based on your Clinician's written prescription.
  • Off-Label Use means that an FDA-approved medication is being prescribed in a manner, dose, population, or indication not specifically approved by the FDA but supported by clinical evidence and the professional judgment of your treating Clinician. Your Clinician will document the clinical rationale for any Off-Label Use in your medical record.
  • Category 2 Substances: Certain peptides and investigational compounds used in Forged Protocols may be classified as Category 2, meaning the FDA has not made a final determination regarding their safety or efficacy. You accept this regulatory uncertainty as a condition of receiving these Protocols.
  • Alternatives available: For most conditions treated with a Compounded Product, an FDA-approved branded alternative may exist. Your Clinician will discuss alternatives with you and document a clinical justification for selecting a Compounded or Off-Label Protocol.
  • Pharmacy relationship: Compounded Products are dispensed by licensed 503A or 503B compounding pharmacies. Forged Wellness & Co. shares only the minimum necessary information (prescription, member demographics, allergies, and relevant clinical data) to enable accurate compounding and dispensing.
  • Adverse Event reporting: In the event of an Adverse Event, the treating Clinician may notify the compounding pharmacy, legal counsel, emergency medical services, and any applicable regulatory body as required by law.

Assumption of Risk

Participation in Forged Wellness & Co.'s services involves inherent risks. By using our services, you acknowledge and voluntarily assume the following risks:

Clinical & Medical Services

IV therapy, hormone replacement therapy, peptide therapy, GLP-1 therapy, blood draws, injections, and other clinical procedures carry risks including but not limited to infection, bruising, allergic reaction, adverse drug interactions, and other complications. All clinical risks will be discussed as part of your informed consent process.

Wellness & Lifestyle Modalities

Where Forged recommends or facilitates access to wellness modalities such as contrast therapy, sauna, cold exposure, red light therapy, or physical training, specific risks will be disclosed in the applicable Treatment-Specific Consent or wellness waiver prior to participation.

Waiver

You may be required to sign a separate Assumption of Risk and Waiver of Liability form as a condition of membership or participation in certain activities. Such waivers supplement but do not replace these Terms.

Lab & Pharmacy Services

Laboratory Services

  • Laboratory tests are ordered by licensed healthcare practitioners based on clinical judgment and your health needs
  • Lab results are one component of your overall health assessment and should be interpreted by a qualified healthcare provider in the context of your complete medical history
  • Lab results are not a diagnosis. Diagnosis and treatment decisions are made by your healthcare practitioner using lab data alongside clinical examination and medical history
  • You have the right to request copies of your lab results at any time

Pharmacy & Compounded-Product Dispensing

  • 503A pharmacies prepare patient-specific Compounded Products pursuant to an individual prescription written by your Clinician. 503A compounds are dispensed to you by name.
  • 503B outsourcing facilities manufacture office-use Compounded Products under cGMP-like controls; these may be administered in-clinic without a patient-specific prescription.
  • Forged Wellness & Co. shares only the minimum necessary information with the dispensing pharmacy required for safe compounding and dispensing.
  • Compounded Products are not FDA-approved as finished drug products. See Section 05 for full disclosures.
  • Storage, handling, and self-administration instructions for any take-home Compounded Product will be reviewed with you at the time of dispensing.

Intellectual Property

All content, materials, and intellectual property associated with Forged Wellness & Co. are owned by or licensed to Forged Wellness & Co. PLLC, including but not limited to:

  • The Forged Wellness & Co. name, logo, and brand identity
  • Website content, design, graphics, and source code
  • The Forged Assessment framework and methodology
  • Proprietary health protocols and programming
  • Marketing materials, photography, and video content

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any Forged Wellness & Co. intellectual property without our prior written consent. "Forged Wellness & Co." and "Extraordinary Health Isn't Found. It's Forged." are trademarks of Forged Wellness & Co. PLLC.

Member Conduct

As a member of Forged Wellness & Co., you agree to:

  • Treat all staff, practitioners, and fellow members with respect and courtesy
  • Follow all facility rules, safety guidelines, and staff instructions
  • Disclose complete and accurate medical history and health information to our practitioners
  • Inform staff immediately of any injury, illness, or medical event occurring on premises
  • Not engage in harassment, discrimination, or threatening behavior
  • Not bring unauthorized substances, weapons, or hazardous materials into any Forged facility
  • Not photograph or record other members or staff without consent
  • Not share your membership credentials or allow others to use your membership

Forged Wellness & Co. reserves the right to revoke or suspend membership for violations of these conduct standards, with or without prior warning, depending on the severity of the violation.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • Forged Wellness & Co. PLLC, its officers, members, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, regardless of the theory of liability
  • Our total aggregate liability for any claims arising from or related to these Terms or our services shall not exceed the total amount you paid to Forged Wellness & Co. in membership fees during the twelve (12) months preceding the claim
  • We are not liable for any damages resulting from circumstances beyond our reasonable control

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, the limitations above shall apply to the fullest extent permitted by law. This limitation does not apply to liability arising from gross negligence or willful misconduct.

Indemnification

You agree to indemnify, defend, and hold harmless Forged Wellness & Co. PLLC, its officers, members, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms
  • Your use or misuse of Forged Wellness & Co. services or facilities
  • Your provision of inaccurate or incomplete health or personal information
  • Your violation of any applicable law or regulation
  • Any third-party claim related to your actions at or in connection with Forged Wellness & Co.

Governing Law

These Terms and any disputes arising out of or related to these Terms or your use of Forged Wellness & Co. services shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of law principles.

Any legal proceedings related to these Terms shall be brought exclusively in the state or federal courts located in Missoula County, Montana. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Dispute Resolution

Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact Forged Wellness & Co. at hello@forgedwellnessco.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve your concern within thirty (30) days.

Mediation

If informal resolution is unsuccessful, both parties agree to attempt mediation before a mutually agreed-upon mediator in Missoula County, Montana, before proceeding to arbitration or litigation. Mediation costs shall be shared equally between the parties.

Binding Arbitration

If mediation is unsuccessful, any remaining dispute shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Missoula County, Montana. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Forged Wellness & Co.

Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters related to intellectual property, data security, or unauthorized access.

Termination

Forged Wellness & Co. reserves the right to suspend or terminate your membership and access to our services at any time for:

  • Violation of these Terms or facility rules
  • Non-payment of membership fees or outstanding balances
  • Conduct that endangers the safety of staff, members, or the facility
  • Providing false or misleading medical or personal information
  • Any other reason deemed necessary to protect the interests of Forged Wellness & Co., its members, or staff

Upon termination, your right to access services ceases immediately. You remain responsible for any outstanding fees or balances owed. Provisions of these Terms that by their nature should survive termination (including limitation of liability, indemnification, governing law, and dispute resolution) shall remain in effect.

Your medical records will be retained in accordance with applicable Montana healthcare regulations and our Privacy Policy, regardless of membership status.

Cancellation & Refund Policy

Telehealth Services

Appointments may be cancelled or rescheduled at no charge if notice is given at least 24 hours before the scheduled time. Cancellations with less than 24 hours' notice may be subject to a cancellation fee as disclosed at booking. Refunds for completed consultations are not issued except as required by law.

Prescription & Compounded Medications

Once a prescription has been sent to and filled by a partner pharmacy, refunds are not available. If medication was not received or arrived damaged, contact hello@forgedwellnessco.com within 7 days of the expected delivery date.

Membership

Cancellation terms, including any notice periods and early termination fees, are specified in your individual Membership Agreement. Submit cancellation requests in writing to hello@forgedwellnessco.com or in person at our Missoula location.

Forged Wellness & Co. partners with licensed compounding pharmacies and laboratory services to fulfill prescriptions and diagnostic testing ordered by our licensed clinicians. Members may receive medication or lab services from one or more of these partners depending on treatment, location, and clinical need.
